Fundamental Rights Enforcement
Your Rights, Enforceable.
Overview
Fundamental rights enshrined in Articles 8 to 28 of the Constitution of Pakistan 1973 form the bedrock of individual liberty and legal protection in Pakistan. These include the right to life (Article 9), freedom of speech (Article 19), freedom of assembly (Article 16), right to property (Article 24), freedom of trade (Article 18), and the right to a fair trial (Article 10-A). The Constitution guarantees that any law inconsistent with fundamental rights is void to the extent of the inconsistency. Our firm specializes in filing constitutional petitions under Article 199 before the High Courts to enforce these rights.
The right to life under Article 9 has been expansively interpreted by the Supreme Court of Pakistan to include the right to a clean environment, the right to health, the right to livelihood, and the right to dignity. Similarly, the right to property under Article 24 protects against compulsory acquisition without adequate compensation. Our petitions invoke these expanded interpretations to obtain relief in matters ranging from environmental degradation to wrongful termination and property deprivation.
Article 199 of the Constitution confers upon the High Courts the power to issue writs of habeas corpus, mandamus, certiorari, prohibition, and quo warranto. This extraordinary constitutional jurisdiction is a powerful tool for challenging executive action that violates fundamental rights. We have extensive experience in drafting and arguing constitutional petitions, obtaining interim relief, and pursuing appeals under Article 185 to the Supreme Court of Pakistan.
