Harassment & Defamation (Criminal)

Holding harassers and defamers accountable under the criminal law.

Overview

Harassment and defamation are increasingly litigated areas of criminal law in Pakistan, reflecting growing awareness of individual dignity and legal protections. Our firm provides comprehensive representation for both complainants (victims) and accused persons in matters involving workplace harassment, sexual harassment, cyber harassment, stalking, criminal defamation, and injurious falsehood. We handle cases under the Pakistan Penal Code 1860, the Prevention of Electronic Crimes Act (PECA) 2016, the Protection Against Harassment of Women at the Workplace Act 2010, and provincial harassment protection laws.

For complainants, we provide vigorous and sensitive representation to ensure that harassment and defamation are addressed through the criminal justice system. We assist in filing FIRs, pursuing investigation by the police or FIA, and prosecuting the offender before trial courts. We also seek protective orders including restraint injunctions and bail cancellation against the accused. In workplace harassment cases, we represent victims in proceedings before the Ombudsperson and the Workplace Harassment Inquiry Committee under the 2010 Act, alongside criminal prosecution where warranted.

For accused persons, we provide strategic defense against allegations of harassment and defamation, which are frequently used as tools of vexatious litigation in personal or commercial disputes. We challenge fabricated FIRs, mala fide complaints, and cases filed without evidentiary basis. We file pre-arrest bail applications, seek quashment of FIRs under Section 561-A CrPC, and defend against conviction with rigorous cross-examination. Our dual perspective — representing both victims and the accused — gives us a comprehensive understanding of this sensitive and legally nuanced practice area.

Process & How We Help

1

Complaint & FIR Registration

For complainants, we assist in drafting and filing the complaint with the police or FIA, ensuring that the FIR accurately captures the legal ingredients of the offense. For the accused, we review the FIR immediately and plan the defense strategy.

2

Investigation & Pre-Trial

We monitor the investigation, ensure timely recording of statements, and challenge any procedural defects. For the accused, we file pre-arrest bail or apply for quashment of the FIR where the allegations are mala fide.

3

Trial & Evidence

We conduct the trial including presentation of documentary evidence (messages, emails, call records, CCTV footage, witness statements) and electronic evidence under the Evidence Order 1984. For complainants, we ensure sensitive handling during cross-examination.

4

Judgment & Enforcement

After conviction, we pursue appropriate sentencing including imprisonment, fines, and compensation. After acquittal, we pursue the complainant for costs and damages if the case was mala fide. We also handle appeals.
