Trial & Post-Arrest Law
Mastering every stage of the criminal trial — from arrest to acquittal.
Overview
The criminal trial process in Pakistan, governed by the CrPC 1898, is a multi-stage proceeding that begins with the arrest and culminates in the judgment of the trial court. Our firm provides end-to-end trial advocacy, representing clients from the moment of arrest through to the final verdict and any subsequent appeals. We appear before Session Courts, Judicial Magistrates, Anti-Terrorism Courts, and Special Courts, ensuring that our clients' rights are protected at every procedural stage.
The trial process under CrPC 1898 includes pre-charge evidence (Chapter XVIII), framing of charge (Chapter XIX), prosecution evidence, examination of the accused under Section 342 CrPC, defense evidence, and final arguments. Our trial team meticulously prepares for each stage, challenging the admissibility of evidence under the Evidence Order 1984, cross-examining prosecution witnesses to expose contradictions and weaknesses, and presenting a robust defense case where available. We also advise on the strategic decision of whether the accused should testify in their own defense.
Post-arrest law extends beyond the trial to include remedies such as discharge under Sections 249-A or 265-K CrPC (where no prima facie case exists), transfer of cases, pleas for separate trials, and applications for bail during trial. We also handle post-conviction remedies including appeals, revisions, and mercy petitions. Our approach is to exhaust every legal avenue to secure acquittal or, where conviction is unavoidable, to minimize the sentence through persuasive mitigation arguments. We have a strong track record of acquittals even in cases where the prosecution's case appeared strong on paper.

Process & How We Help
Post-Arrest Proceedings
Immediately after arrest, we seek police bail (where available), oppose remand applications, and monitor the investigation to prevent police excesses. We file petitions for bail and challenge illegal detention.
Pre-Trial & Discharge
We review the challan (police report), assess whether a prima facie case is made out, and file discharge applications. We challenge the charge framed by the court if it is legally unsustainable.
Trial & Evidence
We cross-examine prosecution witnesses to expose inconsistencies, lead defense evidence including alibi and character witnesses, and examine the accused under Section 342 CrPC. We object to inadmissible evidence under the Evidence Order.
Final Arguments & Judgment
We deliver final oral arguments supported by a written synopsis, cite case law, and address every point in the charge. After judgment, we advise on appeal strategy and file appeals within the limitation period.
